Agreement to Terms

By accessing or using Splashy ("the Bot", "the Service", "we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms apply to all users, including server owners, administrators, and members who interact with Splashy.

Service Description

Splashy is a Discord bot that provides:

  • Server moderation and management tools
  • Automation and custom commands
  • Economy and leveling systems
  • Ticket support system
  • Analytics and insights
  • Web-based dashboard for configuration

We reserve the right to modify, suspend, or discontinue any part of the service at any time with or without notice.

User Obligations and Acceptable Use

You agree to:

  • Comply with Discord's Terms of Service and Community Guidelines
  • Use the bot for lawful purposes only
  • Provide accurate information when required
  • Keep your account credentials secure
  • Respect the rights of other users
  • Not attempt to disrupt or abuse the service

Prohibited Activities

You may NOT use Splashy to:

  • Harass, abuse, or harm others
  • Spam, flood, or send unsolicited messages
  • Share illegal, harmful, or offensive content
  • Attempt to exploit, hack, or reverse-engineer the bot
  • Violate any applicable laws or regulations
  • Circumvent rate limits or access restrictions
  • Use the bot for commercial purposes without authorization
  • Impersonate others or misrepresent your affiliation
  • Scrape data or use automated tools to access the service

Account and Authentication

To access the dashboard and certain features, you must authenticate with Discord. By doing so:

  • You authorize us to access your Discord account information
  • You are responsible for all activities under your account
  • You must notify us immediately of any unauthorized access
  • You must be at least 13 years old to use our services
  • You may have only one account unless otherwise authorized

We reserve the right to suspend or terminate accounts that violate these terms.

Premium Services and Payments

Premium Features

Some features require a premium subscription. Premium services:

  • Are billed on a recurring basis (monthly or annually)
  • Automatically renew unless cancelled
  • May be subject to price changes with notice
  • Can be cancelled at any time from your account

Refund Policy

Refunds are handled on a case-by-case basis. Generally:

  • No refunds for partial months of service
  • Refunds may be provided for service outages or errors
  • Subscriptions remain active until the end of the billing period
  • Contact support within 7 days for refund requests

Intellectual Property Rights

Our Content

All content, features, and functionality of Splashy, including but not limited to text, graphics, logos, code, and software, are owned by us and protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of any content you provide through the service. By using Splashy, you grant us a license to use, store, and process your content solely to provide the service.

License to Use

We grant you a limited, non-exclusive, non-transferable license to use Splashy for its intended purpose. You may not copy, modify, distribute, or create derivative works without explicit permission.

Disclaimers and Limitations

"AS IS" Service

Splashy is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We do not guarantee:

  • Uninterrupted or error-free operation
  • Accuracy or reliability of results
  • That defects will be corrected
  • That the service is free from viruses or harmful components

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of the service.

Discord Integration

Splashy operates on Discord's platform and is subject to Discord's Terms of Service and policies. We are not affiliated with, endorsed by, or sponsored by Discord Inc. Discord is a registered trademark of Discord Inc.

If Discord terminates or suspends your account, you may lose access to Splashy services.

Termination

We may terminate or suspend your access to Splashy immediately, without notice, for:

  • Violation of these Terms of Service
  • Fraudulent or illegal activity
  • Abuse of the service or other users
  • Non-payment of premium services
  • Any reason we deem necessary to protect the service or users

You may terminate your account at any time by removing the bot from your servers and discontinuing use of the dashboard. Upon termination, your data will be handled according to our Privacy Policy.

Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via:

  • Dashboard notification
  • Email to registered users
  • Discord announcement

Continued use of the service after changes constitutes acceptance of the new terms.

Governing Law and Disputes

These terms are governed by the laws of the jurisdiction where we operate, without regard to conflict of law provisions. Any disputes shall be resolved through binding arbitration or in courts located in our jurisdiction.

Severability

If any provision of these terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
